New York State Article VII Process


Permitting and approval for the 20-mile, 345 kV Empire State Line was overseen by the New York State Public Service Commission’s Article VII process. 

Article VII of the New York Public Service Law sets forth a review process for the consideration of any application to construct and operate a major utility transmission facility. The law defines major utility transmission facilities according to technical criteria including capacity and above-ground length.

9/21/2020 Revisions

On September 21, 2020, NEETNY filed updates and revisions to the Environmental Management & Construction Plan (EM&CP) for the Empire State Line Project.

6/24/2020 Revisions

On June 24, 2020, NEETNY filed an Environmental Management & Construction Plan (EM&CP) for the Empire State Line Project.

Project Approval


On June 16, 2020, the New York State Public Service Commission issued its written approval order in the NEETNY ESL Article VII proceeding, formally finding that the Empire State Line Project will serve the public interest, convenience and necessity.

On August 10, 2018, NEETNY filed an Article VII License application for the Empire State Line. The application is posted on the New York State Department of Public Service website at Application of NEETNY for a Certificate of Environmental Compatibility and Public Need Pursuant to Article VII of the Public Service Law for the Empire State Line.
